Old or new regime for 44ADA freelancers
Freelancers on presumptive taxation face the same regime choice as salaried people, but the numbers work differently. Under Section 44ADA you declare 50% of receipts as income and claim no separate business expenses, so the deductions that make the old regime attractive have to come from personal investments and loans instead.
What changed and what did not
The new regime is the default, and Budget 2026 left the slabs unchanged for FY 2026-27. Income up to ₹4 lakh is nil, then 5% to ₹8 lakh, 10% to ₹12 lakh, 15% to ₹16 lakh, 20% to ₹20 lakh, 25% to ₹24 lakh and 30% above. A rebate of up to ₹60,000 makes tax nil when taxable income is ₹12 lakh or less.
The Income Tax Act 2025 governs income earned from 1 April 2026 and renumbers the presumptive sections, with the same 50% rate and limits. The Section 44ADA guide covers who qualifies. This article only compares regimes.
The old regime in brief
Income above ₹2.5 lakh at 5%, above ₹5 lakh at 20%, above ₹10 lakh at 30%, with a rebate only up to ₹5 lakh of income. In exchange you claim deductions such as Section 80C up to ₹1.5 lakh, health insurance under 80D, the extra ₹50,000 for NPS, and interest on a home loan for the house you live in.
Tax compared on three levels of receipts
Resident individual, no other income. Old regime assumes ₹2.25 lakh of deductions, made up of ₹1.5 lakh under 80C, ₹25,000 under 80D and ₹50,000 for NPS. All figures include 4% cess.
| Gross receipts | Presumptive income at 50% | New regime tax | Old regime tax with ₹2.25 lakh deductions |
|---|---|---|---|
| ₹24 lakh | ₹12 lakh | ₹0 | ₹1,11,800 |
| ₹30 lakh | ₹15 lakh | ₹1,09,200 | ₹2,02,800 |
| ₹40 lakh | ₹20 lakh | ₹2,08,000 | ₹3,58,800 |
At ₹15 lakh of income, the old regime needs about ₹5.25 lakh of deductions to match the new regime. The usual mix of 80C, 80D, NPS and home loan interest comes to ₹4 lakh to ₹4.5 lakh, so most 44ADA freelancers are better off in the new regime unless they carry a large home loan or other big deductions.
Switching is not free
Freelancers with business or professional income cannot swap regimes every year the way salaried taxpayers can. You opt out of the new regime by filing a form on the e-filing portal before your return due date, and once you have moved, your freedom to move again is limited. Plan with a few years in view and have your CA confirm the current rules before you file.
Where this fits in your year
Your regime decides the tax you estimate for advance tax, where 44ADA filers pay once by 15 March, and it decides which form you complete. The guides on which ITR form to use and ITR-4 with foreign income cover the filing side. The presumptive taxation guide explains how foreign receipts enter the calculation.
